About the digest
Questions about the IP Case Digest
What is the IP Case Digest?
A searchable collection of headnotes of Indian intellectual property judgments, written by BRB Legal from the judgments themselves. It holds 554 judgments of 18 courts, from 14 December 2022 to 8 June 2026, on patents, trade marks, copyright, designs and geographical indications.
Which judgments does it cover?
Judgments of the Supreme Court and the High Courts, above all the IP Divisions of the Delhi and Madras High Courts and the Calcutta and Bombay High Courts. Most arise from orders of the Patent Office and the Trade Marks Registry: appeals against refusals of patents and trade marks, oppositions and rectifications. Infringement and passing-off suits are included too.
How do I find judgments on a particular section?
Type the section into the search box, for example “3(k)” or “section 11”, or choose it from the provisions list. Every provision decided in 3 or more judgments also has its own case-law page listing them with their headnotes. Sections are always read with their statute: section 9 of the Trade Marks Act and section 9 of the Patents Act are different provisions.
What do the outcome labels mean?
Each judgment carries one of fourteen labels describing what the court ordered, such as Remanded, Set aside, Allowed or Injunction granted. “Direction to grant” marks the 10 judgments in which the court ordered the patent to be granted or the mark registered, instead of sending the matter back. A judgment labelled Dismissed is not always a loss on the merits: some were dismissed on a preliminary point, such as territorial jurisdiction, with liberty to file again.
How often is the digest updated?
New judgments are added in batches, usually every month. Each judgment keeps its address on this website, so links to it continue to work.
Can I rely on a headnote?
A headnote is a summary for reference and is not legal advice. Read the judgment itself, and take advice on your own facts, before relying on it.
