Headnote
Grant directed on the amended claims after the Court ran the obviousness analysis itself. One cited document was directed at analysing bio-process fluids, was not analogous art and could be safely disregarded. A second addressed sector-based redundancy to repair defective memory columns and never mentioned corruption by gamma radiation, so it answered a different problem. Critically, the analogous document taught away: it disclosed that flash EEPROM, DRAM and SRAM corrupt in a gamma environment because they hold data as stored charge, so a person working from it would not turn to a document built on flash EEPROM cells. The redundancy in the two inventions was different in kind, one writing the same material across several regions so that uncorrupted copies survive, the other adding spare cells per sector. Though both the memory type and redundancy were known, the combination for RFID tags surviving 25 to 50 kGray was not obvious without hindsight.
Disposition
Allowed. Impugned order set aside and the application directed to proceed to grant on the basis of the amended claims.
