Headnote
A label was refused over a registered word mark consisting of the common word alone. That word by itself throws no distinctiveness and would not qualify for registration, while the device made the applicant's label reasonably distinctive, and the Registry had no case that any other label carried a similar device. The approach taken was short-sighted.
Disposition
Allowed. Impugned order set aside; the Registry directed to register the applicant's mark.
