DPDP Act FAQs
Can consent be bundled into general terms and conditions?
No. Consent must be specific to a stated purpose, and it must be capable of being given and withdrawn independently. Bundling it into onboarding paperwork, invoices, employment contracts, service agreements or blanket terms and conditions undermines both the specificity and the freedom of the consent. A signature on a form that serves some other primary purpose is not consent to unrelated processing. Where an organisation processes data for several distinct purposes, each should be separately presented so an individual can agree to one without being forced to accept all.
