Trade Mark FAQs

Can a registered trade mark be cancelled for non-use?

Yes. Under section 47, a registered mark can be removed if it has not been used in good faith for a continuous period of five years from the date it was entered on the register, up to three months before the application for removal is made. Keeping evidence of use protects a registration.
