Trade Mark FAQs

Are domain names protected as trade marks?

Yes. The Supreme Court held in Satyam Infoway v. Sifynet Solutions (2004) that a domain name can function as a trade mark and is protected against passing off. Disputes over .in domains are decided under the INDRP, and over generic top-level domains such as .com under the UDRP.
