Headnote
Interim injunction refused to the registered owner of the film title LOOTERE against a web series of the same name. The suit was framed purely in copyright, the plaintiff not being the proprietor of any trade mark, so no question of trade mark infringement arose. The Court held that LOOTERE lacks originality, being a common word for robbers, and that no monopoly can be claimed in it. There was no similarity in the literary works either: the plaintiff's film is a love story while the defendant's web series concerns the hijacking of an Indian vessel by Somali pirates. The plaintiff had also delayed, having noticed the trailer in September 2022 while the series was released in March 2024 and had been streaming since.
