Headnote
Application under section 8 of the Arbitration and Conciliation Act allowed and the parties referred to arbitration under clause 14 of their 2003 partnership deed, the trade mark and copyright suit being disposed of. Applying Vidya Drolia, the Court held that the examination at the referral stage is prima facie only, directed at weeding out manifestly non-existent or invalid arbitration agreements and plainly non-arbitrable disputes, and is not a mini trial. The Court expressly declined to go into the disputes between the partners so that nothing would read as an observation on the merits.
