Refusal set aside and the application for methods and apparatuses for bone restoration remanded, with a delay of 93 days in filing the appeal condoned. Four of the five objections raised in the hearing notice had been waived by the impugned order, which rejected the application on the remaining one without any reasoning, and did so on the unamended claims although an amended set had been filed with the post-hearing written submissions. Applying Agriboard International, the Court held the order to be completely cryptic and lacking any justification for the finding of non-patentability.
