Headnote
An unusual and practically useful order: a defendant already under injunction applied for clearance to launch an alternative product, and the Court compared the proposed design against the registered designs and held it visually different in overall get-up, look and layout, so that it fell outside the existing injunction. Permission to manufacture and market was granted on condition that the specifications be followed scrupulously without variation. The Court expressly did not consider novelty of the registered designs or the invalidity plea, which was not pressed for that application.
