Set aside

Headnote

Refusal set aside and the application for message communication of sensor data directed to proceed to grant on amended claims. The Court examined what problem the cited prior art set out to solve and found it was data management, filtering sensor data and publishing it to a subscribing application only when a pre-set event of interest occurred. The claimed invention addressed a different problem, the complexity of communicating sensor data to subscribing applications, by transmitting it in a form easy to process. Since the prior art did not suggest or motivate, much less teach, that solution, arriving at the claimed invention required ingenuity rather than mere skill in the art. The Court nevertheless held that the claims as framed were too wide and set out the narrower wording required.
