Headnote

One of the few refusals upheld on the merits, and useful for that reason. The Court worked through claim construction, the cited art, the person skilled in the art, the motivation to combine and common general knowledge before concluding that moving a comprehensive vehicle monitoring system from a fixed installation to a portable one was a natural and expected progression rather than a leap. Motivation to combine was found in recognised industry needs apparent from the documents themselves. Common general knowledge was established by named consumer products with their first listing dates on a retail site before the priority date, which is a practical route to proving it. The Court expressly identified and guarded against hindsight bias and still found the path obvious, and noted that no economic benefit of the combination had been set out in the application.
