Headnote
A device claim is not caught by section 3(k) merely because the device uses a computer program to process and display data. The claim was to a parameter display system fitted in a working vehicle, recording data to memory and displaying it, and the application lay in mechanical engineering rather than in computing or mathematics. The same invention had been granted in Japan under a classification for engine controls, which the Controller never considered.
Disposition
Allowed. Matter remitted for fresh consideration by a different Patent Controller.
