An order was set aside where its 'Scientific and Technical Analysis' turned out to be a replication of the cited documents, mechanically assembled from similar sounding components by mosaicing seven prior arts without any justification for combining them. Terrell is quoted, carrying Lowndes' Patent: it is not open to take a packet of prior documents and, by putting a puzzle together, produce what is said to be a disclosure.
Disposition
Allowed. Impugned order set aside and the matter remanded, the findings on merits not binding on the Controller.
