Headnote

Application to reject the plaint for non-compliance with section 12-A of the Commercial Courts Act dismissed. Following Yamini Manohar, the Court held that whether a plaintiff contemplates urgent interim relief is a limited enquiry, to be considered holistically from the plaintiff's standpoint, and that the plaint cannot be rejected even if interim relief is later refused on the merits. A gap of about eight years between the plaintiff first becoming aware and filing the suit did not by itself show that no urgent relief was contemplated, delay going to entitlement rather than to the limited enquiry under section 12-A. The Court added that in IP cases the interests of consumers who may be duped by misuse of a mark are also engaged, not merely the proprietor's rights.
