Headnote

A delay of 425 days was not condoned, the explanation being specious, cursory and flimsy, and the merits failed too. The cited marks were structurally and phonetically similar and registered for a similar category of goods, and to draw a distinction between tyres and automobiles would be too tenuous. That two cited marks co-exist on the register is no excuse for a third.
